Mile High Denver Auto Repair Reminds Motorists of New Cell Phone Law

Established Denver auto repair shop provides friendly reminder to Denver and Colorado area motorists on the December 1, 2009 effective date for new cell phone regulations for drivers.

Denver, Colorado, October 30, 2009 - Mile High Denver Auto Repair today released a public service announcement to remind drivers of the new Colorado legislation concerning use of cell phones. In view of studies that confirm the hazards of using a traditional cell phone while driving, the new state law aims to reduce driving distractions and improve highway safety.

The Colorado legislation known as house bill 1094 prohibits operators of a motor vehicle who are under 18 years of age, operators of a school bus, and motor vehicle carriers regulated by the public utilities commission from using a wireless telephone while a motor vehicle they are operating is in motion. The new law does permit the operators of a motor vehicle who are 18 years of age or older to use a wireless telephone equipped with a hands free accessory. Interested drivers are invited to ask our service consultants about having a Blue Tooth Hands Free Car Kit installed at our shop.

Like many other states around the country, the violation of this cell phone driving law is a secondary offense. A secondary offense means that the driver using a cell phone or mobile communication device must first be violating a primary enforcement law such as reckless driving, speeding or running a red light before they can be ticketed for violating Colorado's cell phone law. The new law takes effect on December 1st, 2009. Fines are established as $50 plus a $6 surcharge for a first offense and $100 plus a $6 surcharge for a second offense.

Drivers that are using any type of instruction permit are prohibited from using any kind of mobile communication device such as a cell phone. This includes text messaging and does not allow for hands free operation of a cell phone. Regardless of age, if you are driving with any kind of learner or instruction permit this law applies.
